Court documents obtained by E! Online state that the former couple have a prenuptial agreement.
Kenny G is said to be seeking joint custody of the pair's 14-year-old son Noah.
Benson-Gorelick's January filing, which cited irreconcilable differences as the reason behind the split, had requested full physical custody of the teen.
Divorce lawyer Laura Wasser - who has previously acted for Kim Kardashian, Britney Spears and Christina Aguilera - is representing Kenny G.
Kenny G and Benson-Gorelick married in May 1992.
