Kimberly Buffington-Quaid - who moved with her husband to California over the summer - has petitioned for joint legal custody and sole physical custody of the couple's 2-year-old twins Thomas and Zoe, according to TMZ.
The What to Expect When You're Expecting star is said to have been allocated visitation rights in the papers, but is expected to be asked to pay spousal support and attorney's fees.
Buffington-Quaid - who initially filed for divorce in March but withdrew her petition two months later - has reportedly hired high-profile celebrity divorce lawyer Laura Wasser to front her proceedings.
Wasser has previously been involved in the dissolution of the marriages of Britney Spears, Angelina Jolie and Mariah Carey.
"Kimberly is fed up with Dennis's cheating and wants out of the marriage," an alleged source close to the couple told TMZ. "He's not a good husband."
It is rumoured that Buffington-Quaid has held back on full divorce proceedings as a result of the couple's move.
California law states that divorce applicants must have been a resident of the state for six months before their petition is considered, meaning the Texan real estate agent needs to wait a few more months before she can file for dissolution.
Last month, Quaid, who was previously married to PJ Soles and Meg Ryan, was sued by a 70-year-old man who was injured during a riding accident on the actor's former estate.
