The CSI: NY actor was taken into custody in Scottsdale, Arizona in the early hours of January 21, E! News reports.
According to police documents, Giovinazzo was arrested after failing to stay in lane in his Jeep Wrangler.
Although he initially claimed that he was driving "erratically" because he was trying to use his GPS, Giovinazzo eventually confessed that he had recently drunk scotch at the W Hotel.
The arresting officer explained that he could smell "intoxicating beverage" and noted Giovinazzo's "watery bloodshot eyes", "slurring", "unsteady" gait and "dishevelled" clothing.
After performing sobriety tests and a breathalyser, Giovinazzo was taken into custody, although the policeman praised his conduct throughout the incident.
"During transport Carmine repeatedly apologised to me and told me he didn't want to be an 'asshole' and he thanked me many times for not treating him like a criminal and showing him respect," the officer wrote in his report. "Carmine was very polite and co-operative with me throughout the investigation."
Giovinazzo, who split from his wife Vanessa Marcil last summer, was later released from custody but will appear in court at a later date.
