Mickey Rourke was arrested on suspicion of driving under the influence of alcohol in Miami Beach yesterday morning.

The Sin City actor was stopped by police in the early hours of the morning after he swerved in front of them on his Vespa.

According to the arrest report, Rourke claimed: "I'm not drunk, I didn't even drink that much." But police officers claim he had a flushed face, bloodshot eyes and he was slurring his speech.

Reports claim Rourke failed alcohol tests and was booked and held on a $1,000 bond.

Photographer Fred Montana witnessed the incident and saw the actor with a lady friend earlier in the evening. He said: "They came back out (of Miami hot spot Mansion) two hours later and crossed Washington Avenue to go to his scooter.

"They both got on it, and he did a U-turn to go north. He was pulled over within a block.

"The cop says to him: 'You swerved right in front of me.' And Mickey answered: 'No, no, dude, I'm all right.'"

Montana added: "He could not do the walk in a straight line."
