Britney Spears' lawyer has quit the singer's ongoing custody battle with ex-husband Kevin Federline.

Sorrell Trope submitted a request to be withdrawn from the case because of a 'breakdown in communication' between Spears and the law firm.

Trope is the third lawyer to take on the star's case to win the custody rights of sons two-year-old Sean Preston and one-year-old Jayden James.

The court document filed yesterday said: "There has been a breakdown in communications between (Spears) and Trope & Trope (law firm) making further representation of her interests impossible."

The lawyer revealed to People magazine that the court must grant the request before he can leave Spears.

He said: "A lawyer cannot simply withdraw from a case. We will ask the court to relieve us."

A hearing is to be held on February 4. Another hearing will then be held over the custody battle on February 19.
