The Pulp Fiction co-writer was driving in the city of Ojai, northwest of Los Angeles, at around one in the morning on Sunday when the crash happened.
Captain Monica McGrath of the Ventura County Sheriff's Department said that a passenger in Avary's car, 34-year-old Andreas Zedini, died at a local hospital from his injuries.
Avary's wife, who had also been a passenger in his car at the time, was taken to hospital with serious injuries.
The screenwriter was released from prison after he posted a $50,000 (£25,000) bail fee.
