Anthony Salerno said he was confident that she would receive the standard minimum sentence for a first-time charge of driving under the influence, including a fine of approximately $1,600 and a three-month alcohol education programme.
The former OC star was charged with DUI, possession of marijuana and driving without a valid licence earlier this week.
However, Salerno predicted that the licence charge would be treated as an infraction, while the marijuana charge would be dismissed.
Barton was not present at yesterday's hearing, which saw her case continued until April 10. However, Salerno said she was "very relieved" that she had not been charged with felony possession of narcotics.
The 22-year-old was arrested last December when police saw her white Range Rover crossing two lanes of traffic in West Hollywood.
She later admitted she was "disappointed" with herself over the incident.
