TMZ reports that Follieri, a property developer, had written a cheque for $250,000 to a PR firm but didn't have enough funds in his account to honour it.
The 29-year-old has been released from custody by the NYPD.
Follieri also faced a lawsuit from billionaire Ron Burkle after he was accused of wasting $1.3 million in business funds to support his lifestyle.
Hathaway is the star of The Devil Wears Prada and will next be seen opposite Steve Carell in spy comedy Get Smart.
Katherine Heigl recently revealed Hathaway turned down her role in Knocked Up because of the graphic birth scene. "I think Anne found the film a little too radical, especially with the shot at the end!" Heigl said.
