Judge Elizabeth Allen White announced her decision after the jury was still deadlocked and unable to reach a verdict on Monday.
Nine members of the 12-person jury returned to the court today to explain to Judge Allen they could not reach a decision on the case.
However, the jury appeared to be in favour of Sheridan with an eight-four vote - one short of the nine needed to make a decision.
Sheridan previously filed a wrongful termination civil lawsuit against Desperate Housewives creator Marc Cherry, alleging that Cherry hit her on the head.
Last week, Judge Allen dropped the battery charges against Cherry, which left ABC involved in the $6 million (£3.7 million) lawsuit.
Lawyers for ABC and Sheridan said that they will look into a new trial in the civil lawsuit.
