The original Survivor winner was put back behind bars in March after it emerged that he failed to pay an estimated $2 million in taxes and penalties relating to his prize from the CBS show.
Hatch spent three years in prison back in 2006 for the same charge, but failed to follow through with his promise to refile his taxes from 2000 and 2001 - the year of his Survivor victory.
The 50-year-old has since argued to a federal appeals court that his latest sentence should be overturned, as it exceeded prosecutors' recommendations by three months.
The Celebrity Apprentice star has also called for the court to either toss out his case or order further hearings, E! Online reports.
Donald Trump warned shortly after the verdict that he "may get involved" and help Hatch walk free.
