The lawsuit comes three months after Abercrombie & Fitch announced that it had made The Situation a financial offer to stop wearing the brand's clothing.
The Situation called Abercrombie & Fitch's offer a publicity stunt, and later instructed his lawyers to pursue legal action against the retailer.
Attorneys for the reality star have now officially filed a suit against Abercrombie & Fitch in a Florida court and are seeking $4m (£2.5m) in damages, according to documents obtained by TMZ.
The Situation alleges that the clothing company violated his trademarks by releasing T-shirts emblazoned with the phrases 'The Fitchuation' and 'GTL… You Know The Deal', which parody Sorrentino's popular slogans.
Abercrombie & Fitch has not yet responded to the suit.
This week, actress Chloe Sevigny objected to Abercrombie & Fitch's request for The Situation to refrain from wearing its clothing and invited Jersey Shore's stars to try out her Opening Ceremony fashion line.
Jersey Shore returns for a fifth season in 2012 on MTV.
