The controversial panellist spoke out after Danniella Westbrook was saved over Mikey Graham in Sunday night's skate-off.
Gardiner and fellow judge Nicky Slater both voted to keep Graham in the competition after the stars had performed. However, they were outnumbered by Robin Cousins, Karen Barber and Emma Bunton, who chose to grant Westbrook a reprieve despite her struggle with the required solo spins.
Speaking to The Sun, Gardiner commented: "In the skate-off Mikey upped the ante and nailed three solo spins which was the required element. So how you can put through somebody who couldn't get the proper required element?
"Mikey was very graceful and elegant and it was a good solid performance. He was robbed. He can be very proud. He shouldn't have gone.
"I'm shocked the other judges didn't vote Danniella off - there is no doubt everyone has their favourites now."
Gardiner has previously used his Twitter page to complain about the result.
