CBS ordered the pilot in July, but according to Deadline, casting and scheduling difficulties led to the postponement of shooting this autumn.
A stalled search for a fourth leading man and Shaloub's commitments to Lincoln Centre Theater's 75th anniversary production of Clifford Odets's Golden Boy on Broadway in November halted plans.
Shaloub and Penn have both agreed to filming in January, by which time a fourth castmate will be chosen.
Kal Penn was most recently seen as a host for the Democratic National Convention, where he mocked Clint Eastwood's 'invisible Obama' speech.
