Rake - a remake of the Australian series of the same name - was first announced last month.
Both cable and broadcast networks expressed an interest in the project, which eventually landed at Fox with a pilot production commitment, according to Deadline.
Like the original, Fox's Rake will focus on Cleaver Greene (Kinnear), a brilliant but self-destructive criminal defence lawyer. Moulin Rouge! actor Richard Roxburgh played the role in the Australian series.
The pilot for the US remake will be written by Peter Duncan, who co-created the original show, while Roxburgh will serve as an executive producer.
If picked up to series, Rake would mark Kinnear's first regular television acting role - the Oscar-nominated actor recently appeared on TV in mini-series The Kennedys and has also played guest roles on Friends and Modern Family.
